They’re not regulated the same as other tobacco products: E-cigarettes and other similar products aren’t currently regulated by the U.S. Food and Drug Administration (FDA). The FDA has proposed rules that would bring them under the agency’s purview, but those rules have yet to be finalized. Until then, they’re sold as unregulated tobacco products.

The health risks of e-cigarettes aren’t fully understood, but some research suggests they’re not completely safe.
